MILLION DOLLAR SUMMER PROMOTION T&Cs
Part A – Promotion Details
1. Information About the Promotion
1.1 Information on how to enter and the prizes form part of these Terms and Conditions (“Terms”).
1.2 Participation in Hyro’s Million Dollar Summer (“Promotion”) is deemed acceptance of these Terms.
2. Promoter
2.1 The promoter is Hyro Pty Ltd (ABN 32 671 846 790) of 10/27 Sydney Road, Manly NSW 2095 (“Promoter”).
2.2 Enquiries about the Promotion can be sent to hello@drinkhyro.com
3. Promotional Period
3.1 The Promotion opens at 12:01am AEDT on 7 October 2026 and closes at 11:59pm AEDT on 27 January 2027 (“Promotional Period”).
3.2 Entries received outside the Promotional Period will not be accepted. The Promoter’s system records are final and conclusive as to the time an entry is received.
4. Eligibility
4.1 Entry is only open to persons who:
(a) are residents of Australia, excluding residents of South Australia and the Australian Capital Territory; and
(b) are aged 18 years or over at the time of entry.
4.2 Employees of the Promoter and of its associated agencies, contractors, suppliers, insurers and any business involved in running the Promotion or determining the winner, and their immediate family members, are ineligible to enter.
4.3 “Immediate family member” means a spouse, ex-spouse, de facto spouse, child or step-child (natural or adopted), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
5. Qualifying Purchase
5.1 To receive an entry, an eligible entrant (“Eligible Entrant”) must purchase any Hyro product through the Promoter’s official website drinkhyro.com.au during the Promotional Period (“Qualifying Purchase”). Orders with a total paid value of $0 (including free gifts, welcome kits, samples and replacement orders) and purchases of gift cards are not Qualifying Purchases.
5.2 An autoship (subscription) rebill order charged through drinkhyro.com.au during the Promotional Period is a Qualifying Purchase and earns entries under Clause 7.3.
5.3 An order that is cancelled, refunded, reversed or charged back is not a Qualifying Purchase, and any entry issued for it will be void.
5.4 The cost of a Qualifying Purchase is no greater than it would be without the opportunity to enter the Promotion. No separate entry fee is charged.
6. How to Enter
6.1 To enter, an Eligible Entrant must complete a Qualifying Purchase during the Promotional Period. Each Qualifying Purchase is entered automatically using the name, email address, phone number and postcode on the order.
6.2 Entrants are responsible for ensuring their order details are accurate and current. Any prize will only be awarded to the person named on the Qualifying Purchase. Entries made on behalf of another person or by a third party are invalid.
6.3 An entry is deemed received when the Qualifying Purchase has been successfully processed and recorded by the Promoter’s systems.
7. Entries and Bonus Entries
7.1 Each Qualifying Purchase provides one (1) entry, unless it is an autoship rebill order under Clause 7.3.
7.2 Eligible Entrants can also earn the following entries during the Promotional Period, subject to Clauses 7.3 to 7.8:
| Action | Entries |
|---|---|
| Autoship rebill order | 5 |
| Photo with your Hyro, tagging @drinkhyro | 5 |
| Refer a friend through your customer portal | 20 |
7.3 Autoship rebill. Each autoship rebill order successfully charged during the Promotional Period earns five (5) entries. The first order that starts a subscription is a standard Qualifying Purchase and earns one (1) entry.
7.4 Photo. An Eligible Entrant earns five (5) entries by posting a photo of themselves with a Hyro product to Instagram or TikTok from a public account and tagging @drinkhyro during the Promotional Period. To qualify, the entrant must then send a direct message to @drinkhyro on the same platform with the order number of their Qualifying Purchase, so the bonus entries can be matched to their customer account. A photo bonus is not valid until that message is received. Limit one (1) photo bonus per person per day.
7.5 A photo must be the entrant’s own original work, must not show any other identifiable person without their consent, and must not be offensive, defamatory, unlawful or in breach of any third party’s rights. By posting, the entrant grants the Promoter a non-exclusive, royalty-free, perpetual licence to use, reproduce and publish the photo in any media for marketing purposes. The Promoter may reject any photo that does not meet this clause.
7.6 Refer a friend. An Eligible Entrant earns twenty (20) entries each time an Eligible Entrant they refer through the referral link in their Hyro customer portal completes their first Qualifying Purchase as a new customer during the Promotional Period. The referred friend receives their own entry for that purchase. Self-referrals, referrals of existing customers, and referrals where the friend’s order is cancelled, refunded or charged back do not earn bonus entries.
7.7 Entries earned under Clauses 7.4 and 7.6 are bonus entries. To earn bonus entries, an entrant must have made at least one Qualifying Purchase during the Promotional Period. Bonus entries are allocated to the entrant’s customer account once the Promoter has verified the action, and must be earned before the Promotional Period closes.
7.8 The maximum number of entries per person is one hundred (100), including all entries from Qualifying Purchases and all bonus entries. Any purchase or action after that limit is reached will not earn further entries.
7.9 This Promotion is in no way sponsored, endorsed, administered by or associated with Instagram, Meta or TikTok. Entrants provide their information to the Promoter and not to those platforms, and release them from all liability in connection with the Promotion.
7.10 Any duplicated, altered, manipulated, fraudulent or otherwise invalid entry will be rejected.
8. Proof of Purchase
8.1 Entrants must retain proof of purchase for all Qualifying Purchases. Proof of purchase must clearly identify the product purchased and the date of purchase.
8.2 Failure to provide proof of purchase on request may result in disqualification.
9. The Draw
9.1 The draw will take place at Hyro Head Office, 10/27 Sydney Road, Manly NSW 2095 at 12:00pm AEDT on 4 February 2027 using computerised random selection from all valid entries received during the Promotional Period.
9.2 The first valid entry drawn (“Finalist”) wins the opportunity to play the envelope game described in Clause 11 (“Game”) and is guaranteed to win no less than AUD $20,000.
9.3 An independent prize adjudicator (“Adjudicator”) will attend the draw to confirm it is conducted in line with these Terms. The draw conductor may draw additional reserve entries in case an invalid entry or ineligible entrant is drawn.
9.4 The Finalist is determined by chance. The draw is open to public scrutiny and anyone may witness it on request. If the draw date falls on a weekend or public holiday, the draw will be held at the same time and place on the next business day.
10. Finalist Notification and Verification
10.1 The Finalist will be notified by phone and email within two (2) business days of the draw. The Finalist’s initial, surname and postcode will be published on drinkhyro.com.au by 5 February 2027.
10.2 To play the Game or claim a prize, the Finalist must provide, to the Promoter’s satisfaction:
(a) a valid, current Australian driver’s licence, Australian passport or government-issued proof of age card;
(b) if that ID does not show their current residential address, a utility bill or bank statement issued within the last three (3) months; and
(c) proof of purchase for a Qualifying Purchase and, if the drawn entry is a bonus entry, evidence of the action that earned it.
10.3 The name on the evidence must match the name on the Qualifying Purchase. If it does not, the Finalist must provide legal documentation linking the two.
10.4 If the Finalist cannot be contacted, or has not claimed and been verified by 12:00pm AEDT on 15 March 2027, their entry is invalid and they forfeit the opportunity to play the Game. Clause 13 then applies.
11. The Game
11.1 The Game will be held at a Sydney location between 15 February 2027 and 15 March 2027. The Promoter may change the location based on the Finalist’s location and venue availability. The exact date, time and location will be confirmed with the Finalist with reasonable notice.
11.2 The Finalist may play in person or by live video call. A Finalist who attends in person is responsible for their own travel to and from the Game. A Finalist who plays by video call must join the link provided with camera and sound on, and hold their physical photo ID up to the camera at the start of the call for verification by the Promoter and the Adjudicator.
11.3 If the Finalist cannot attend, they may appoint a proxy aged 18 or over to play for them by giving the Promoter signed written notice before the Game starts. If neither the Finalist nor a proxy attends for any reason, a representative of the Promoter will play the Game on the Finalist’s behalf.
11.4 The Finalist, proxy or representative who plays the Game is the “Player”.
11.5 At the start of the Game, twenty (20) sealed envelopes numbered 1 to 20 will be on display. Two (2) envelopes contain a winning symbol. The other eighteen (18) contain a consolation symbol. The envelopes are prepared, sealed and shuffled by or under the supervision of the Adjudicator before the Game, and their contents are recorded in a sealed Control Envelope held by the Adjudicator.
11.6 The Player has one (1) attempt. The Player must nominate two (2) different numbers between 1 and 20. The Adjudicator will then select and open the two (2) envelopes bearing those numbers. A nomination is final once made. If there is any dispute about the numbers nominated, the Promoter’s decision is final.
11.7 The result of the Game determines the prize:
| Outcome | Envelopes opened | Prize |
|---|---|---|
| Jackpot Prize | Both contain a winning symbol | AUD $1,000,000 |
| Secondary Prize | One winning symbol and one consolation symbol | AUD $50,000 |
| Guaranteed Prize | Both contain a consolation symbol | AUD $20,000 |
11.8 Only one (1) prize will be awarded. For example, if the Finalist wins the Secondary Prize, the Jackpot Prize and the Guaranteed Prize will not be awarded.
11.9 The Adjudicator will also attend the Game to confirm it is conducted in line with these Terms. If the Jackpot Prize is selected, the Adjudicator will collect all envelopes for validation before the prize is confirmed. If the Jackpot Prize is not selected, the Adjudicator will open the Control Envelope to show the Player where the winning envelopes were.
11.10 All outcomes are subject to verification by the Promoter and the Adjudicator. A Player who breaches these Terms or the conditions of the Game may be disqualified, along with the Finalist they are playing for.
11.11 The Game may be filmed, photographed, live-streamed and published by the Promoter.
12. Prizes
12.1 The Promoter guarantees that the Finalist will win at least AUD $20,000. The maximum total prize pool is AUD $1,000,000.
12.2 The prize will be paid by bank transfer to an Australian bank account in the Finalist’s name within thirty (30) business days of the Game and successful verification.
12.3 Prizes are not transferable, exchangeable or redeemable for any other benefit except at the Promoter’s sole discretion.
12.4 The Promoter accepts no responsibility for any tax implications of winning a prize. The Finalist should seek independent financial advice.
13. Unclaimed Prizes
13.1 If the Finalist forfeits under Clause 10.4, an unclaimed prize draw will be held at the same place as the original draw at 12:00pm AEDT on 17 March 2027 to select a replacement Finalist. Reserve entries may also be drawn.
13.2 The replacement Finalist will be notified by phone and email, and their initial, surname and postcode published on drinkhyro.com.au, by 24 March 2027. Their Game will be held between 25 March 2027 and 23 April 2027. They must claim and be verified by 12:00pm AEST on 23 April 2027, failing which they forfeit and the Promoter may withdraw the prize unawarded, subject to any direction from a regulator.
13.3 If the Game has been played and a prize won, the Finalist has three (3) months from the date of the Game to provide the details needed to pay the prize. If they do not, and the Promoter has taken all reasonable steps to contact them, the prize is forfeited and a redraw for that specific cash amount will be held at the same place as the original draw.
13.4 For clarity, once the Game has been played, any prize tier that was not won is not an unclaimed prize.
13.5 If no winner is determined, or a winner cannot be found after all reasonable efforts, the Promoter will publish that fact on drinkhyro.com.au.
Part B – General Conditions
14. Verification and Audit Rights
14.1 The Promoter may at any time verify the validity of entries, purchases and entrants, including an entrant’s identity, age and place of residence.
14.2 The Promoter may require entrants to provide documentation reasonably necessary to establish eligibility. Failure to provide it within the timeframe specified by the Promoter may result in disqualification, and no substitute prize will be offered.
15. System Integrity and Fraud
15.1 The Promoter may monitor participation and investigate suspected misconduct.
15.2 Any attempt to interfere with, manipulate, automate, duplicate, scrape, hack, bypass security measures, gain unauthorised access to, or otherwise compromise the operation or integrity of the Promotion may result in disqualification. Use of automated entry software or any other means of entering repeatedly by automation is prohibited and may invalidate all of that person’s entries.
15.3 The Promoter may invalidate any entry reasonably suspected of being submitted in breach of these Terms.
16. Publicity and Release
16.1 The Finalist agrees to take part in all reasonable marketing and editorial activity relating to the Promotion, including being recorded, photographed, filmed and interviewed. The Promoter may use that material in any media without further reference or payment to the Finalist.
16.2 The Finalist may be required to sign a legal release, in a form determined by the Promoter, before playing the Game or receiving a prize.
16.3 The Promoter may refuse to allow a Finalist or proxy to take part in the Game if it reasonably determines they are not in a fit condition to participate safely. In that case a representative of the Promoter will play on the Finalist’s behalf.
17. Privacy
17.1 Personal information collected in connection with the Promotion will be handled in accordance with the Promoter’s Privacy Policy at drinkhyro.com.au/policies/privacy-policy and applicable privacy laws.
17.2 The Promoter collects personal information to administer the Promotion, verify eligibility, award prizes and communicate with entrants. It may disclose that information to its related entities, contractors, agents, the Adjudicator, the prize insurer and other service providers helping to run the Promotion, and to State and Territory regulators as required by law. Some of the Promoter’s service providers (including e-commerce, email and data hosting providers) may store or process personal information outside Australia, including in the United States.
17.3 By entering, entrants consent to receive email or SMS messages that relate primarily to the conduct of the Promotion, which may not include an unsubscribe facility.
17.4 An entrant who does not provide the personal information requested may be ineligible to enter or claim a prize. The Privacy Policy explains how to access or correct personal information and how to make a privacy complaint.
18. Consumer Rights and Limitation of Liability
18.1 Nothing in these Terms restricts, excludes or modifies any statutory consumer rights under any applicable law, including the Competition and Consumer Act 2010 (Cth).
18.2 To the maximum extent permitted by law, the Promoter and its associated agencies and companies exclude all liability for any loss (including indirect, special or consequential loss and loss of profits), expense, damage, personal injury or death suffered in connection with the Promotion or the acceptance or use of a prize. This exclusion does not apply to the extent the Promoter caused or contributed to the loss, or to liability that cannot be excluded by law, in which case liability is limited to the minimum allowed by law.
18.3 The Promoter is not responsible for any technical failure, communications or network fault, or late, lost or misdirected order or communication that affects entry, other than to the extent required by law.
19. Promoter Rights
19.1 If any part of the Promotion cannot run as planned for reasons beyond the Promoter’s control, including computer virus, network failure, bugs, tampering, unauthorised intervention, fraud or technical failure, the Promoter may cancel, terminate, modify or suspend the Promotion, invalidate affected entries, or suspend or modify a prize, subject to any direction from a State or Territory regulator.
19.2 Failure by the Promoter to enforce any of its rights at any stage is not a waiver of those rights.
20. Dispute Resolution
20.1 Any dispute about the conduct of the Promotion or the claiming of a prize must be submitted in writing to the Promoter within fourteen (14) days of the event giving rise to the dispute.
20.2 The Promoter will assess each dispute in good faith, in direct consultation with the entrant, and provide a written determination. If the dispute cannot be resolved, the Promoter’s decision, acting reasonably, is final.
21. Governing Law
21.1 These Terms are governed by the laws of New South Wales, Australia.
21.2 Any dispute arising in connection with the Promotion is subject to the exclusive jurisdiction of the courts of New South Wales.
22. Permits
