4.2 Residents of South Australia and the Australian Capital Territory are not eligible to enter or participate in the Promotion.

4.3 Employees of the Promoter, and its associated agencies, contractors and suppliers, and their immediate family members, are ineligible to enter.

5. Early Access Registration

5.1 Prior to Commencement, individuals may register their interest through drinkhyro.com.au.

5.2 Individuals who successfully complete an Early Access Registration may receive priority access to purchase promotional products before the Promotion opens to the general public.

5.3 Completion of an Early Access Registration does not constitute entry into the Promotion and does not guarantee the ability to purchase promotional products.

5.4 The Promoter reserves the right to limit, suspend, amend or cancel Early Access Registration at its discretion.

6. Early Access Period

6.1 A one (1) hour Early Access Period will commence immediately prior to the public launch of the Promotion.

6.2 During the Early Access Period, only individuals who have completed an Early Access Registration through drinkhyro.com.au may purchase promotional products and receive entries into the Promotion.

6.3 Following the conclusion of the Early Access Period, the Promotion will open to the general public.

6.4 The Promoter reserves the right to vary, suspend or cancel the Early Access Period where reasonably necessary.

7. Qualifying Purchase

7.1 To receive an entry, an eligible entrant (“Eligible Entrant”) must purchase a Hyro Perform Lemon Lime or Hyro Perform Raspberry pouch through the Promoter’s official online sales channels and website drinkhyro.com.au (“Qualifying Purchase”).

8. How to Enter

8.1 To enter the Promotion, an Eligible Entrant must, during the Promotional Period, complete a Qualifying Purchase.

8.2 Following the Vault Activation Event (as defined in Clause 12), the Promoter will issue, to the email address associated with the Qualifying Purchase, a secure link to the promotional website.

8.3 To submit an entry, the Eligible Entrant must access that link, confirm their first name, last name, order confirmation number, email address, phone number and postcode, and accept these Terms.

8.4 Each Qualifying Purchase is automatically validated against the entrant’s order records by the Promoter’s systems and entitles the entrant to one (1) entry.

8.5 An entry is deemed received when it has been successfully submitted and accepted by the Promoter’s systems.

9. Qualifying Entry Requirement

9.1 All entrants must hold a valid qualifying entry to participate in the Promotion. A qualifying entry is an entry that:

(a) is associated with a Qualifying Purchase;

(b) is submitted during the Promotional Period; and

(c) complies with these Terms.

9.2 Only entrants holding a valid qualifying entry will be eligible to access the Hyro $50K Vault (“Vault”), submit a four-digit code combination and win the Vault Prize.

9.3 The Promoter reserves the right to reject, invalidate or disqualify any entry that does not satisfy the requirements of a qualifying entry.

10. Entry Limits

10.1 Each Qualifying Purchase provides one (1) valid entry, associated with one (1) Qualifying Purchase.

10.2 Any duplicated, altered, manipulated, fraudulent or otherwise invalid entry will be rejected.

10.3 An Eligible Entrant may make multiple Qualifying Purchases and will receive one (1) valid entry per Qualifying Purchase, up to a maximum of 10,000 entries per participant.

10.4 Entries will continue to be issued until the Vault Prize has been awarded.

11. Proof of Purchase

11.1 Entrants must retain proof of purchase for all Qualifying Purchases.

11.2 Proof of purchase must clearly identify the product purchased and the date of purchase.

11.3 Failure to provide proof of purchase upon request may result in disqualification.

12. Vault Activation

12.1 The Vault will remain unavailable (locked) until the earlier of:

(a) 10,000 valid entries having been issued by the Promoter; or

(b) 11:59pm AEST on the date that is sixty (60) days after Commencement,

whichever occurs first (the “Vault Activation Event”).

12.2 Once the Vault Activation Event occurs, Eligible Entrants holding a valid qualifying entry will be granted access to submit their four-digit code combinations in an attempt to unlock the Vault.

12.3 The Promoter may stagger, queue or otherwise manage access to the Vault in order to ensure system stability, fairness and security.

13. Vault Access Timing

13.1 Following the Vault Activation Event, access to submit a four-digit code combination will be granted to an Eligible Entrant twenty-four (24) hours after the time of their relevant Qualifying Purchase.

13.2 This time delay applies to protect the integrity of the Promotion against fraudulent or reversed transactions.

14. Vault Mechanic

14.1 The Vault is protected by a predetermined winning four-digit code combination selected by the Promoter before the Vault Activation Event (the “Winning Combination”). The Winning Combination will be securely recorded before the Vault Activation Event.

14.2 Each valid qualifying entry entitles the entrant to one (1) four-digit code submission following the Vault Activation Event.

14.3 Entrants may submit any four-digit code combination between 0000 and 9999, regardless of whether that combination has previously been submitted by another entrant.

14.4 Once a four-digit code combination has been successfully submitted and recorded by the Promoter’s systems, that submission is final and cannot be changed, transferred or withdrawn.

14.5 If the successfully submitted combination matches the Winning Combination, the entrant will immediately unlock the Vault and win the AUD $50,000 Vault Prize, subject to verification.

14.6 If the submitted combination does not match the Winning Combination, it will be recorded as a non-winning combination. The Promoter may display previously submitted non-winning combinations on the promotional website.

15. Odds

15.1 The odds of any single entry matching the Winning Combination are 1 in 10,000.

15.2 The odds of any remaining entry matching the Winning Combination may improve over time to the extent that the Vault Prize remains unclaimed and the Promoter elects to display previously submitted non-winning combinations.

16. Prize

16.1 The Promoter guarantees one (1) cash prize of AUD $50,000 (“Vault Prize”).

16.2 The Vault Prize will be paid via Bank Transfer to a legitimate Australian bank account in two equal installments of AUD $25,000, 30 days apart. The first payment will be made within thirty (30) days, following a successful verification.

16.3 The Vault Prize is not transferable, exchangeable or redeemable for any other benefit except at the Promoter’s sole discretion.

16.4 If no prize winner is determined, or a prize winner cannot be found after all reasonable efforts to make contact, the Promoter will publish that fact on the promotional website.

17. Winner Determination and Verification

17.1 The first entrant holding a valid qualifying entry whose successfully submitted combination matches the Winning Combination will be the winner of the Vault Prize, subject to verification.

17.2 The time recorded by the Promoter’s systems when a combination is successfully submitted will be the official record for determining the winner.

17.3 Before awarding the prize, the Promoter may verify: (a) identity; (b) age; (c) residential address; (d) proof of purchase; and (e) compliance with these Terms.

17.4 If the provisional winner is unable to satisfy verification requirements, the Promoter may disqualify that entrant and continue the Promotion until an eligible winner is determined.

17.5 Once the Winning Combination has been successfully submitted and verified, the Vault Prize will be awarded and the Promotion will immediately conclude.

18. Unclaimed Prize and Long-Stop Draw

18.1 If a winner cannot be contacted, fails verification, is found to be ineligible, or otherwise forfeits the prize, the Promoter reserves the right to continue the Promotion until an eligible entrant successfully unlocks the Vault.

18.2 If the Winning Combination has not been successfully submitted by the Long-Stop Date, the Promoter will award the Vault Prize by random draw conducted among all entrants holding a valid qualifying entry.

18.3 The random draw will be conducted within seven (7) days of the Long-Stop Date at the Promoter’s premises, and the drawn winner will be subject to the verification requirements set out in Clause 17.

18.4 The Promoter guarantees that the AUD $50,000 Vault Prize will be awarded.

18.5 The random draw will be conducted using a random selection system and with a third party adjudicator. The name of the winner will be published on the promotional website within seven (7) days of the draw.

19. Winner Notification

19.1 The winner will be notified by telephone and email within seven (7) days of verification.

19.2 The winner’s name may be published on the Promoter’s website, social media channels and promotional materials as permitted by law.

20. Verification and Audit Rights

20.1 The Promoter reserves the right at any time to verify the validity of entries, purchases and entrants.

20.2 The Promoter may require entrants to provide documentation reasonably necessary to establish eligibility.

20.3 Failure to provide requested information within the timeframe specified by the Promoter may result in disqualification.

21. System Integrity and Fraud

21.1 The Promoter reserves the right to monitor participation and investigate suspected misconduct.

21.2 Any attempt to interfere with, manipulate, automate, duplicate, scrape, hack, bypass security measures, gain unauthorised access, or otherwise compromise the operation or integrity of the Promotion may result in disqualification.

21.3 The Promoter may invalidate any entry reasonably suspected of being submitted in breach of these Terms.

22. Privacy

22.1 Personal information collected in connection with the Promotion will be handled in accordance with the Promoter’s Privacy Policy and applicable privacy laws.

22.2 Information collected may be used for administering the Promotion, verifying eligibility, awarding prizes and communicating with entrants.

23. Limitation of Liability

23.1 To the maximum extent permitted by law, the Promoter excludes all liability for any loss, damage or injury suffered in connection with participation in the Promotion or acceptance and use of the prize, except for liability that cannot be excluded by law.

24. Promoter Rights

24.1 The Promoter reserves the right to amend, suspend, terminate, modify or cancel the Promotion where reasonably necessary due to circumstances outside its control, subject to applicable laws.

25. Dispute Resolution

25.1 Any dispute regarding the conduct of the Promotion or the claiming of a prize must be submitted in writing to the Promoter within fourteen (14) days of the event giving rise to the dispute.

25.2 The Promoter will assess each dispute in good faith and provide a written determination to the entrant. Subject to clause 26 (Decisions), the Promoter’s determination of a dispute is final.

26. Decisions

26.1 All decisions made by the Promoter regarding the Promotion are final and no correspondence will be entered into.

27. Governing Law

27.1 These Terms are governed by the laws of New South Wales, Australia.

27.2 Any dispute arising in connection with the Promotion will be subject to the exclusive jurisdiction of the courts of New South Wales.
